These Terms and Conditions (the “Terms”) govern your use of www.unisonmentalhealth.com (the “Site”) and the services offered through it. The Site is owned and operated by Unison Mental Health Pty Ltd (ABN 48 678 132 888) (“Unison Mental Health”, “we”, “us”, or “our”).

By using this Site, you confirm that you have read, understood, and agree to be bound by these Terms at all times. If you do not agree to these Terms, please do not use this Site.

Important: Unison Mental Health is not a crisis service. If you or someone you know is in immediate danger, please call 000. For mental health crisis support, contact Lifeline on 13 11 14 or Beyond Blue on 1300 22 4636.

1. Intellectual Property

All content published and made available on our Site is the property of Unison Mental Health Pty Ltd and its creators. This includes, but is not limited to, images, text, logos, documents, downloadable files, and any other material that contributes to the composition of our Site.

You may not reproduce, distribute, modify, or otherwise use our content without our prior written permission, except as permitted by applicable law.

2. Professional Services

Unison Mental Health is a psychology, counselling, and psychotherapy practice offering mental health services in Melbourne and via telehealth across Australia. The following services are available through our Site or by referral:

  • Individual therapy

  • Relationship and couples therapy

  • Sex therapy

  • Trauma and PTSD support

  • LGBTQIA+ and gender-affirming therapy

  • Support for kink, polyamorous, and ethically non-monogamous (ENM) communities

  • ADF/veteran support (Open Arms and other referral pathways)

  • Employee Assistance Program (EAP) services

  • Integration and harm-reduction support

The following resources and materials are also available through our Site:

  • Guides and information resources

  • Self-assessment tools and quizzes

  • Blog articles and educational content

All clinical services are provided by qualified practitioners in accordance with Australian professional and ethical standards. Our practitioners are registered with or members of the relevant professional bodies, including AHPRA, the Australian Counselling Association (ACA), or the Australian Association of Social Workers (AASW).

Services are provided both in-person at our Carlton, Victoria practice and via telehealth, subject to availability and clinical suitability.

3. Not a Substitute for Emergency Care

The information and services on this Site are intended for general mental health support and are not a substitute for emergency medical or psychological care. If you are experiencing a mental health crisis or are in immediate danger, do not rely on this Site — contact emergency services (000), Lifeline (13 11 14), or present to your nearest hospital emergency department.

4. Eligibility

Our services are intended for individuals aged 18 years and over unless otherwise stated. Where services are provided to clients under 18, appropriate parental or guardian consent is required in accordance with our clinical policies and applicable law.

5. Purchase of Services and Resources

These Terms govern the purchase of services and resources available on or through our Site.

All information, descriptions, or materials we provide about our services are as accurate as possible. However, we cannot guarantee that all information is entirely free from error and are not legally bound by descriptions or images to the extent permitted by law.

Session fees are charged in accordance with our current fee schedule, which is available on our Site. Fees may be updated from time to time. You will be informed of applicable fees prior to booking.

Medicare rebates, private health insurance rebates, and other third-party funded arrangements are subject to eligibility criteria set by the relevant funding body. Unison Mental Health does not guarantee eligibility for any rebate or funded program.

We reserve the right to modify, reject, or cancel a booking whenever it becomes necessary. If we cancel a confirmed appointment and you have already paid, we will provide a refund equal to the amount paid. It is your responsibility to monitor your payment method to verify receipt of any refund.

6. Payment

We accept the following payment methods:

  • Credit card

  • Debit card

Payment is required at the time of service unless a prior arrangement has been made in writing. By providing your payment information, you authorise us to charge the applicable fee to your nominated payment method.

If we believe a payment has violated any law or these Terms, we reserve the right to cancel or reverse the transaction.

7. Cancellation and Rescheduling Policy

We understand that circumstances can change. Our cancellation policy is as follows:

  • More than 48 hours’ notice: No charge. Changes and cancellations are free of charge.

  • Between 48 and 24 hours’ notice: 50% of the session fee will be charged.

  • Less than 24 hours’ notice, or failure to attend (no-show): The full session fee will be charged.

Notice may be given by phone call, SMS, or email to the contact details listed in Section 13 of these Terms. It is your responsibility to ensure your notice is received.

We recognise that genuine emergencies occur. In exceptional circumstances, cancellation fees may be waived at our discretion.

8. Telehealth Services

Telehealth sessions are delivered via video conferencing platforms. By booking a telehealth session, you agree to:

  • Ensure you have a suitable private space and reliable internet connection for the duration of your session.

  • Not record the session without the prior written consent of your treating practitioner.

  • Understand that telehealth may not be appropriate for all presentations, and your practitioner may recommend a different mode of care if clinically indicated.

Technical difficulties affecting telehealth sessions will be managed on a case-by-case basis and will not automatically attract a cancellation fee where the fault is attributable to our systems.

9. Confidentiality and Privacy

Unison Mental Health is committed to protecting your privacy. Information collected through this Site and in the course of providing services is handled in accordance with our Privacy Policy, available at www.unisonmentalhealth.com/privacy-policy/, and the Privacy Act 1988 (Cth).

Clinical confidentiality is a cornerstone of our practice. Information shared during therapy is kept confidential, subject to mandatory legal and ethical obligations, including but not limited to:

  • Risk of harm to you or to others

  • Mandatory reporting obligations under applicable child protection legislation

  • Subpoena or court order

  • Obligations under relevant professional codes of conduct

Your treating practitioner will discuss the limits of confidentiality with you at the commencement of your therapeutic relationship.

10. Consumer Protection

Where the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms will not limit your legal rights and remedies under that legislation. These Terms will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and that legislation, the mandatory provisions of the legislation will apply.

Our Site contains links to third-party websites or services that we do not own or control. We are not responsible for the content, policies, or practices of any third-party website or service linked to our Site. It is your responsibility to read the terms and conditions and privacy policies of any third-party sites before using them.

12. Limitation of Liability

To the extent permitted by law, Unison Mental Health Pty Ltd and our directors, officers, agents, employees, contractors, and affiliates will not be liable for any actions, claims, losses, damages, liabilities, or expenses (including legal fees) arising from your use of the Site or the information contained on it.

Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy that you may have under the Australian Consumer Law or any other applicable law that cannot be excluded, restricted, or modified.

13. Indemnity

Except where prohibited by law, by using this Site you agree to indemnify and hold harmless Unison Mental Health Pty Ltd and our directors, officers, agents, employees, contractors, and affiliates from and against any actions, claims, losses, damages, liabilities, and expenses (including legal fees) arising out of your use of our Site or your violation of these Terms.

14. Applicable Law

These Terms are governed by and construed in accordance with the laws of the State of Victoria, Australia. You agree to submit to the exclusive jurisdiction of the courts of Victoria for any disputes arising under these Terms.

15. Severability

If any provision of these Terms is found to be invalid, unenforceable, or inconsistent with applicable laws, that provision will be deemed void and severed from these Terms. All remaining provisions will continue in full force and effect.

16. Changes to These Terms

We may amend these Terms from time to time to maintain compliance with applicable law or to reflect changes in how we operate our Site or deliver our services. We will notify users of material changes by posting an updated version on our Site and, where appropriate, by email. Your continued use of the Site following any changes constitutes your acceptance of the updated Terms.

17. Acknowledgement of Country

Unison Mental Health respectfully acknowledges the Traditional Custodians of the unceded lands on which we work and live, the Wurundjeri People of the Kulin Nation. We celebrate the diversity of Aboriginal and Torres Strait Islander peoples and acknowledge their deep connection to the lands and waters of Australia.
